TERMS & CONDITIONS - THE BASICS
Welcome to Pretty Luxxe Kreations. By accessing and using our website and graphic design services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our services.

“Client”: Refers to any individual or entity who engages Pretty Luxxe Kreations for graphic design services.
“Company”: Refers to Pretty Luxxe Kreations, the provider of the website and graphic design services.
“Services”: Refers to the graphic design and related services provided by Pretty Luxxe Kreations.

2. Acceptance of Terms

The Client is entitled to a specified number of revisions, as outlined in the project contract. Any additional revisions beyond this may incur additional fees.
3.3 Turnaround Time
Turnaround times for each project will be outlined in the project contract. The Company will make every effort to meet deadlines, but cannot be held responsible for delays due to unforeseen circumstances or delays caused by the Client.
4. Payment
4.1 Fees
The fees for the services will be outlined in the project contract. The Client agrees to pay the fees as specified.
4.2 Payment Terms
Payment terms will be detailed in the project contract. Generally, a deposit is required to begin work, with the balance due upon completion of the project.
4.3 Late Payments
Late payments may incur additional charges, as specified in the project contract. The Company reserves the right to suspend work or withhold deliverables until payment is received in full.
5. Intellectual Property
5.1 Ownership
All designs created by Pretty Luxxe Kreations remain the intellectual property of the Company until full payment is received. Upon full payment, the Client will be granted full rights to the final design, as specified in the project contract.
5.2 Usage Rights
The Client is granted usage rights to the final design for the purposes outlined in the project contract. The Company reserves the right to showcase the work in its portfolio and marketing materials unless otherwise agreed upon in writing.
5.3 Third-Party Assets
Any third-party assets (e.g., stock images, fonts) used in the design will be licensed to the Client as per the terms of the third-party provider. The Company is not responsible for any licensing issues arising from the Client’s use of third-party assets outside the agreed-upon project scope.
6. Confidentiality
Both the Client and the Company agree to maintain the confidentiality of any proprietary information shared during the course of the project. This includes, but is not limited to, business plans, financial information, and marketing strategies.
7. Warranties and Disclaimers
7.1 No Warranty
Pretty Luxxe Kreations makes no warranties, express or implied, regarding the website or the services provided. The website and services are provided "as is" and "as available."
7.2 Limitation of Liability
In no event shall Pretty Luxxe Kreations be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services or website.
7.3 Indemnification
The Client agrees to indemnify and hold harmless Pretty Luxxe Kreations from any claims, losses, damages, liabilities, including legal fees, arising out of the Client’s use of the services or website.
8. Termination
8.1 Termination by Client
The Client may terminate the project at any time by providing written notice to Pretty Luxxe Kreations. The Client will be responsible for payment of all work completed up to the termination date, as well as any additional costs incurred by the Company as a result of the termination.
8.2 Termination by Company
Pretty Luxxe Kreations reserves the right to terminate the project or suspend services if the Client fails to comply with these terms and conditions, including non-payment of fees.
9. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Pretty Luxxe Kreations operates, without regard to its conflict of law provisions.
10. Changes to Terms
Pretty Luxxe Kreations reserves the right to modify these terms and conditions at any time. Any changes will be posted on the website and will take effect immediately. The Client's continued use of the website or services constitutes acceptance of the revised terms.
