LEGAL COMPANY POLICIES

Pretty Luxxe Kreations ("the Company") is committed to providing high-quality website and graphic design services to our clients. This policy outlines the terms and conditions under which we operate and provides legal guidelines that govern our relationship with clients.

1. Scope

This policy applies to all clients engaging with Pretty Luxxe Kreations for website design, graphic design, and related services. By contracting our services, clients agree to comply with the terms set forth in this policy.

2. Intellectual Property

 All designs, including but not limited to logos, website layouts, and graphics, created by Pretty Luxxe Kreations, are the intellectual property of the Company until full payment is received. Upon full payment, ownership rights are transferred to the client, except for the right to use the design for promotional purposes by the Company.

 Clients must ensure that any materials, such as images or text, provided to Pretty Luxxe Kreations for use in designs are free of copyright infringement. The client is responsible for obtaining any necessary licenses or permissions.

3. Client Confidentiality

 The Company shall maintain the confidentiality of any proprietary or sensitive information provided by the client. This information will not be disclosed to third parties without the client's explicit consent, except as required by law.

 Upon request, the Company will enter into an NDA to further protect the client's confidential information.

4. Payment Terms

 A non-refundable deposit of 50% is required before the commencement of any project. This deposit secures the project in our schedule.

 The remaining balance is due upon project completion and before the final delivery of design files.

A late fee of $15 per month will be charged for payments not received within 2 days of the invoice date.

5. Revisions and Changes

 The project scope, including design specifications and deadlines, will be agreed upon before work begins.

 Clients are entitled to 3 free revisions per project. Additional revisions will incur extra charges, which will be agreed upon in advance.

Any requests for additional work outside the agreed-upon scope may result in additional charges and adjustments to the project timeline.

6. Termination and Cancellation

 Pretty Luxxe Kreations reserves the right to terminate a project if the client breaches the terms of this policy or fails to make timely payments.

 If a client wishes to cancel the project, the deposit will be forfeited, and any work completed up to the cancellation date will be billed at the hourly rate of $50.

7. Warranties and Liability

 Pretty Luxxe Kreations does not guarantee specific results or outcomes from the design services provided.

The Company’s liability for any damages arising from the services provided shall not exceed the total amount paid by the client for the project.

8. Dispute Resolution

 In the event of a dispute, both parties agree to attempt to resolve the matter through informal negotiation before pursuing legal action.

 If a resolution cannot be reached through negotiation, the parties agree to participate in mediation before escalating the matter to court.

9. Amendments

Pretty Luxxe Kreations reserves the right to amend this policy at any time. Clients will be notified of any changes, and continued engagement with our services will constitute acceptance of the new terms.

10. Governing Law

This policy shall be governed by and construed in accordance with the laws of State Of Ohio.

REFUND POLICY  

  • Design Services: Due to the custom and time-intensive nature of our design services, Pretty Luxxe Kreations does not offer refunds once work has commenced on a project. We commit significant resources and creative effort to each design project, and as such, all sales are final.

  • Client Satisfaction: We prioritize client satisfaction and strive to ensure that each design project meets or exceeds the client's expectations. Throughout the design process, clients will have the opportunity to provide feedback and request revisions to ensure that the final product aligns with their vision.

  • Exceptional Circumstances: In rare cases where Pretty Luxxe Kreations is unable to fulfill its obligations due to unforeseen circumstances or technical limitations, clients may be eligible for a refund of any payments made for services not yet rendered.

Shipping Policy 

  1. Delivery of Digital Products: Pretty Luxxe Kreations specializes in website and logo design services, which are primarily digital products. Upon completion of the design project and receipt of full payment, digital files will be delivered electronically to the client via email or through a secure online platform.

  2. Turnaround Time: The turnaround time for design projects will be communicated to the client upon commencement of the project. While Pretty Luxxe Kreations strives to meet agreed-upon deadlines, please note that the turnaround time may vary depending on the complexity of the project and current workload.

  3. No Physical Shipping: As our services primarily involve digital products, Pretty Luxxe Kreations does not engage in physical shipping of goods. All deliverables will be sent electronically to the client's provided email address or made available for download via a secure online platform.
